Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and the operator of DaycareOn ("DaycareOn", "we", "us", or "our"). They govern your access to and use of daycareon.com, our mobile applications, Chrome extension, APIs, and AI-assistant connectors (collectively, the "Service").

By creating an account, clicking to accept, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) to create an account. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

You may register as a parent/family user or as a provider user. Sign-in methods may include email and password, Google OAuth, and passkeys (WebAuthn) where supported. You are responsible for:

  • providing accurate account and profile information;
  • keeping your credentials and devices secure; and
  • all activity under your account, except unauthorized access you promptly report to us.

Do not share login credentials. Team access for providers and family sharing must use the invite or sharing features we provide.

2. Nature of the Service

DaycareOn is a technology platform and directory. We help families discover childcare programs and help providers manage listings, waitlists, messaging, enrollment workflows, and—where enabled—payment collection. We are not a childcare provider, placement agency, insurer, lender, or employer of providers or families.

Any care arrangement, enrollment decision, waitlist placement, tuition, deposit, schedule, or dispute about care is solely between the family and the provider. DaycareOn is not a party to those arrangements and does not guarantee openings, licensing status, quality of care, responses, or outcomes.

3. Listings and information accuracy

Listing data may come from public open-data sources, provider submissions, or both. Fees, capacity, intake status, licensing labels, commute estimates, and similar details can be incomplete, outdated, or wrong. Unless a listing is expressly marked as verified by DaycareOn, we do not independently verify listing content. Always confirm material facts directly with the provider before relying on them.

4. Family use — inquiries, applications, and profiles

When you inquire, apply, message, or share a profile through the Service, you authorize us to transmit that information to the relevant provider (and their authorized team members). You represent that you have the right to provide information about children and other family members you include.

Some contact features may be subject to credits, rate limits, or fees disclosed in the product. Unused credits have no cash value unless we expressly say otherwise.

5. Provider use

If you claim or manage a listing, you represent that you are authorized to operate or represent that program and that information you submit is accurate and lawful. You are responsible for:

  • compliance with childcare licensing and consumer laws that apply to you;
  • having a lawful basis to upload or process family and child information;
  • your messages, waitlist decisions, enrollment forms, attendance, and care updates; and
  • invitations you send to co-managers and the access they receive.

Optional paid plans (such as DaycareOn Plus) may unlock additional tools. Plan features, pricing, renewal, and cancellation are described at checkout and in the billing portal. We may change plan packaging prospectively with notice in the product or by email.

6. Payments

Certain providers may request deposits, one-time fees, or recurring tuition through the Service. Payment processing is provided by Stripe, Inc. and its affiliates ("Stripe"). By paying or enabling payouts, you also agree to the applicable Stripe terms.

6.1 Families

  • Card and payment-method details are collected by Stripe, not stored by DaycareOn as full card numbers.
  • The provider—not DaycareOn—sets the amount and description of each charge and is responsible for delivering the related care or enrollment benefit.
  • For recurring tuition, you authorize recurring charges until you or the provider cancels according to the tools we provide (such as the billing portal) or Stripe's processes.
  • Refund, cancellation, and chargeback rights may be limited by the provider's policies, Stripe's rules, and applicable law. Contact the provider first about amount or care disputes; contact us for platform or technical payment issues at hello@daycareon.com.

6.2 Providers

  • To receive payouts you must complete Stripe Connect onboarding and keep identity and bank details accurate. DaycareOn does not store your bank credentials.
  • DaycareOn may deduct a platform application fee on transactions. The applicable fee is disclosed in the product or at payout setup and may change prospectively.
  • You may only request payments you are legally entitled to collect. Fraudulent, misleading, or unauthorized payment requests are grounds for suspension and may be reported.
  • Under Stripe's Connect model, platform and Stripe fees, refunds, and disputes may affect your net payout. You remain responsible for tax reporting on amounts you receive.

7. Messaging and communications

The Service may send transactional email and, if you enable them, push notifications. Marketing email is sent only with consent where required (including CASL in Canada) and you may withdraw consent. You agree not to use messaging features for spam, harassment, unlawful content, or solicitation unrelated to childcare arrangements facilitated through the Service.

8. AI assistant connectors and browser extension

Optional connectors (for example via the Model Context Protocol) and the Chrome extension are part of the Service and subject to these Terms and the Privacy Policy. Third-party AI providers process prompts and responses under their own terms when you use those connectors. The extension only performs form-filling and page assistance when you request it and does not submit forms on your behalf.

9. Acceptable use

You agree not to:

  • scrape, bulk-download, or systematically extract listing or user data outside ordinary interactive use;
  • submit false, misleading, or infringing content;
  • harass, defraud, discriminate unlawfully, or misrepresent yourself to families or providers;
  • probe, bypass, or disrupt security, access controls, payments, or rate limits;
  • reverse engineer the Service except to the extent such restriction is prohibited by law; or
  • use the Service for any unlawful purpose.

10. Intellectual property

The Service, including our name, logos, software, and site design, is owned by us or our licensors. You receive a limited, revocable, non-exclusive license to use the Service for its intended purpose. Public open-data listing sources remain subject to their own licenses. You retain ownership of content you submit and grant us a worldwide, non-exclusive license to host, process, display, and transmit it as needed to operate the Service.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE OR CURRENT, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PROVIDER OR FAMILY WILL PERFORM AS EXPECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYCAREON AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO DAYCAREON FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO PROVIDERS THROUGH STRIPE FOR CARE-RELATED CHARGES); OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

13. Indemnity

You will defend, indemnify, and hold harmless DaycareOn and its directors, officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your content or use of the Service; (b) your breach of these Terms; (c) your violation of law or third-party rights; or (d) if you are a provider, your care arrangements, payment requests, or handling of family or child data.

14. Suspension and termination

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, create risk or legal exposure, or if required by law or a payment partner. You may stop using the Service at any time and may delete your account from Settings where available, or by emailing hello@daycareon.com. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

15. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes may also be notified in-product or by email. Continued use after the effective date constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules. Subject to mandatory consumer protections where you live, the courts of Ontario sitting in Toronto will have exclusive jurisdiction over disputes arising from these Terms or the Service.

17. General

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices may be sent to your account email or posted on the Service.
